Terms and Conditions

This website ("Digi Credit") and the Digi Credit mobile application (together, the "Platform") are owned and operated by ISEOUS. Digi Credit acts as a digital loan application and facilitation platform only. Loans available on the Platform are issued and disbursed exclusively by Khosya Finlease Private Limited, a Reserve Bank of India registered NonBanking Financial Company (NBFC). ISEOUS does not approve loans, determine interest rates, or make lending decisions.

Introduction

Please read these Terms and Conditions ("Terms") carefully before accessing or using the Digi Credit mobile application or web-based platform (hereinafter referred to as the "Platform") operated by ISEOUS having its principal place of business at 211, New Delhi House, 27 Barakhamba Road, Delhi–110 001 ("ISEOUS", "we", "our", "us").

By accessing or using the Platform, you ("User", "you", or "your") confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations in India.

Legal Basis

This document is published in compliance with and shall be governed by the following Indian laws:

  • The Indian Contract Act, 1872
  • The Information Technology Act, 2000 and the rules thereunder, including:
    • Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011
    • Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
  • The Reserve Bank of India Act, 1934
  • The Payment and Settlement Systems Act, 2007
  • Relevant circulars, master directions, and digital lending guidelines issued by the Reserve Bank of India (RBI)
  • Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 and UIDAI guidelines regarding Aadhaar Offline KYC

This is an electronic record under the Information Technology Act, 2000. It does not require any physical or digital signature.

Definitions

User/Customer/You: A natural person who accesses or uses the Platform to avail financial services.

ISEOUS/We/Us/Our: ISEOUS operating the Digi Credit application.

Platform: The Digi Credit mobile and web-based application.

Lending Partner: Khosya Finlease Private Limited (NBFC) and any other bank, NBFC, or RBI-regulated financial institution offering credit or related services through the Platform.

Eligibility

To use the Platform and its services, you must:

  • Be an Indian citizen
  • Be at least 21 years of age
  • Be legally competent to contract under the Indian Contract Act, 1872
  • Not be prohibited from accessing financial services under any applicable law

ISEOUS and its Lending Partners reserve the right to refuse service without obligation to provide reasons.

Digi Credit (ISEOUS) operates only as a digital facilitation platform. All underwriting, loan approval, disbursal, and collections activities are handled solely by Khosya Finlease Private Limited (NBFC). Applying on Digi Credit does not guarantee loan approval.

Consent and Information Sharing

By using the Platform, you voluntarily:

  • Consent to the collection, storage, and sharing of your personal and financial data, including KYC, PAN, Aadhaar (as permitted), and credit reports
  • Authorise ISEOUS to share your information with Lending Partners, Credit Information Companies (CICs), KYC repositories (e.g., CKYC), UIDAI-authorised agencies, service providers, and regulatory authorities
  • Acknowledge that non-consent or withdrawal of consent may restrict access to services

Know Your Customer (KYC) Compliance

You agree to provide valid and accurate documents to fulfil KYC requirements under:

  • RBI's Master Directions on KYC, 2023 (as updated)
  • UIDAI guidelines for Aadhaar-based Offline KYC
  • CERSAI's CKYC framework

KYC may be completed using one or more of the following:

  • Aadhaar Offline e-KYC (XML or Secure QR Code)
  • Central KYC (CKYC) using CERSAI
  • PAN + additional government-issued ID (e.g., Voter ID, Driving Licence)

Failure to complete KYC may result in denial or withdrawal of services.

Aadhaar Offline KYC – Terms & Consent

You may voluntarily submit your Aadhaar number for Offline KYC (per UIDAI guidelines). By doing so, you:

  • Authorise ISEOUS to collect demographic details from your Aadhaar XML or QR code for the purpose of identity verification
  • Acknowledge that such data will only be used for regulatory KYC compliance, credit underwriting, and service delivery
  • Authorise ISEOUS and its Lending Partners to share and submit KYC data to CKYC/CERSAI or other regulators as mandated
  • Understand that your Aadhaar number will be masked and secured, and the Aadhaar XML will be deleted post verification, per UIDAI norms
  • Authorise ISEOUS to generate captcha and share code or read OTP as necessary for completing Aadhaar-based offline verification, where applicable

You are under no legal obligation to share your Aadhaar and may request an alternative KYC method.

CKYC (Central KYC) – Terms & Consent

By opting for CKYC:

  • You authorise ISEOUS to access your KYC data from CERSAI for identity verification
  • You confirm the accuracy of details (such as PAN, Date of Birth) for CKYC match
  • You understand CKYC data will be used only for regulatory and service-related purposes
  • You agree that any mismatch may result in rejection or delay of services
  • You consent to ISEOUS and its Lending Partners using this data for credit evaluation and regulatory filings

User Obligations

You agree to:

  • Provide accurate, up-to-date, and complete information
  • Not impersonate another person or create false accounts
  • Not misuse, disrupt, or compromise the Platform
  • Maintain the confidentiality of your login credentials
  • Update your information promptly in case of any change

Communication and Notifications

You consent to receive transactional and service-related alerts via:

  • SMS
  • Mobile app notifications
  • Email
  • RCS
  • WhatsApp
  • Phone calls (including automated systems)

Such communications are essential for your use of the Platform and cannot be opted out while availing services.

Loan Terms and Relationship with Lending Partners

  • All loans are offered and serviced by RBI-regulated Lending Partners
  • Loan terms, interest rates, tenures, and fees will be specified in the loan agreement
  • You must comply with the repayment terms; any default may result in legal recovery, credit bureau reporting, and penalties
  • ISEOUS acts as a technology intermediary and does not provide credit directly. All loans are issued and disbursed by Khosya Finlease Private Limited (NBFC).

Loan Pricing & Illustration

Example: For a loan of ₹10,000 for 12 months at 24% APR, the interest payable is ₹1,344. Total amount payable is ₹11,344 (exclusive of applicable processing charges, if any). Approval and pricing depend on credit assessment by Khosya Finlease Private Limited.

Interest rates, processing fees, and other charges are determined by Khosya Finlease Private Limited based on your credit profile, loan amount, tenure, and other risk factors. All pricing details will be clearly disclosed in your loan agreement before you accept the loan offer.

Data Security & Privacy

  • ISEOUS implements reasonable security practices under the Information Technology Act, 2000 and UIDAI/Aadhaar guidelines
  • Your data is encrypted, stored securely, and shared only with authorised entities
  • You have the right to access, rectify, or revoke your data consent under applicable law

Termination

ISEOUS reserves the right to suspend or terminate your access to the Platform in case of:

  • Breach of these Terms
  • Misuse or fraud
  • Legal or regulatory requirements

Termination shall not affect obligations or liabilities incurred prior to the date of termination.

Amendments

These Terms may be amended from time to time. Continued use of the Platform after changes are made shall constitute your acceptance. Users are encouraged to review the Terms periodically.

Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of competent courts in New Delhi, India.
